If a MiFID investment firm or a third country investment firm appoints a person to act under its full and unconditional responsibility but only for the purpose of selling, or advising clients in relation to, structured deposits (and not any of the activities within section 39(7) of the Act24), that person will not be a tied agent in respect of that activity.(2)
