124The following are not eligible complainants:(1) (in all jurisdictions) a firm, payment service provider,3electronic money issuer, 626 or VJ participant whose complaint relates in any way to an activity which:829(a) the firm itself has permission to carry on; or(ab) 3the firm,626payment service provider or electronic money issuer626 itself is entitled to carry on under the Payment Services Regulations or the Electronic Money Regulations ; or626626(b) the VJ participant itself

(1) A firm communicating with an eligible counterparty2 should have regard to the application of COBS to eligible counterparty business (COBS 1 Annex 1 Part 1).(2) This chapter does not apply in relation to communicating with an eligible counterparty other than the section on compensation information (see COBS 4.4) 2but elements of the requirements in PRIN may apply.
