protected items

5(as defined in section 413 of the Act (Protected items)) communications (and items which they enclose or refer to and which are in the possession of a person entitled to possession of them) between:

1. (a) a professional legal adviser and his client or any person representing his client; or
1. (b) a professional legal adviser, his client or any person representing his client and any other person;

where the communication or the item is made:

1. (i) in connection with the giving of legal advice to the client; or
1. (ii) in connection with, or in contemplation of, legal proceedings and for the purposes of those proceedings; and

is not held with the intention of furthering a criminal purpose.
