  1. (a) (in relation to a specified investment) the investment specified in article 82(2) of the Regulated Activities Order (Rights under a pension scheme) which is rights under a personal pension scheme in (b);36
  2. (b) (in relation to a scheme) (in accordance with article 3(1) of the Regulated Activities Order) a pension scheme or arrangement which:36
    1. (i) is not an occupational pension scheme or stakeholder pension scheme; and
    2. (ii) is comprised in one or more instruments or agreements capable of providing benefits on retirement, death or on having reached a particular age.
