overseas person

(in accordance with article 3(1) of the Regulated Activities Order (Interpretation)) a person who:

1. (a) carries on any of the following regulated activities:
   1. (i) dealing in investments as principal;
   2. (ii) dealing in investments as agent;
   3. (iii) arranging (bringing about) deals in investments;
   4. (iv) arranging (bringing about) regulated mortgage contracts;
   5. (v) making arrangements with a view to regulated mortgage contracts;
   6. (vi) making arrangements with a view to transactions in investments;
   7. (vii) managing investments;
   8. (viii) safe custody and administering investments;
   9. (ix) sending dematerialised instructions;
   10. (x) causing dematerialised instructions to be sent;
   11. 65(xa) managing a UK UCITS96;
   12. 65(xb) acting as trustee or depositary of a UK UCITS96;
   13. 65(xc) managing an AIF;
   14. 65(xd) acting as trustee or depositary of an AIF;
   15. (xi) establishing, operating or winding up a collective investment scheme;

   19. (xiv) establishing, operating or winding up a stakeholder pension scheme;
   20. (xiva) establishing, operating or winding up a personal pension scheme;
   21. (xv) advising on investments;
   22. (xvi) advising on regulated mortgage contracts ;
   23. (xvii) entering into a regulated mortgage contract ;
   24. (xviii) administering a regulated mortgage contract ;
   25. (xix) arranging (bringing about) a home reversion plan;
   26. (xx) making arrangements with a view to a home reversion plan;
   27. (xxi) advising on a home reversion plan;
   28. (xxii) entering into a home reversion plan;
   29. (xxiii) administering a home reversion plan;
   30. (xxiv) arranging (bringing about) a home purchase plan;
   31. (xxv) making arrangements with a view to a home purchase plan;
   32. (xxvi) advising on a home purchase plan;
   33. (xxvii) entering into a home purchase plan;
   34. (xxviii) administering a home purchase plan;
   35. (xxix) agreeing to carry on those regulated activities, disregarding the exclusion in article 72 of the Regulated Activities Order (Overseas persons); but
2. (b) does not carry on any such activities, or offer to do so, from a permanent place of business maintained by him in the United Kingdom.
