affected investment

  1. 174(1) a sanctioned investment; or
  2. (2) an investment in (a) which falls within any of the limbs in (b).
    1. (a)
      1. (i) A transferable security within limb (2) of that definition.
      2. (ii) A money-market instrument.
      3. (iii) A unit in a collective investment scheme.
      4. (iv) A share in an AIF.
    2. (b)
      1. (i) The investment is issued or guaranteed by:
        1. (A) the Government of, or a central authority in, an affected country;
        2. (B) a regional or local authority of an affected country; or
        3. (C) the central bank of an affected country.
      2. (ii) The investment is issued or guaranteed by an issuer which:
        1. (A) has its principal place of business in an affected country; or
        2. (B) has such significant economic ties to an affected country that fair valuation of the investment is no longer possible, regardless of where the investment is listed or traded.
      3. (iii) The investment is a right or interest in another affected investment issued by an issuer in (ii).
      4. (iv) The investment is denominated in the currency of an affected country.
      5. (v) On 24 February 2022, the investment was listed or traded on a market or MTF in an affected country.
      6. (vi) Prior to 24 February 2022, the investment was offered, or was offered for private placement, in an affected country.
      7. (vii) The investment is a unit in a collective investment scheme or a share in an AIF which has suspended redemptions as a result of investing substantially in one or more:
        1. (A) sanctioned investments; or
        2. (B) investments in (2)(a) which fall within any of (i) to (vi) above.
