economically equivalent OTC contract

1. 119(1) in respect of a commodity derivative traded on a trading venue, an OTC derivative which has identical contractual specifications and terms and conditions, excluding the following, to those of that commodity derivative:
   1. (a) different lot size specifications;
   2. (b) delivery dates diverging by less than one calendar day; and
   3. (c) different post-trade risk management arrangements; and
2. (2) in respect of an emission allowance traded on a trading venue, a contract which has identical contractual specifications and terms and conditions, excluding the following, to those of that emission allowance:
   1. (a) different lot size specifications;
   2. (b) delivery dates diverging by less than one calendar day; and
   3. (c) different post-trade risk management arrangements.
