43(in accordance with Article 4(14) of the Banking Consolidation Directive and Article 350 of the Capital Adequacy Directive (Definitions)) an institution which has an institution or a financial institution as a subsidiary undertaking or which holds a participation in such an institution, and which is not itself a subsidiary undertaking of another institution authorised in the same EEA State, or of a financial holding company set up in the same EEA State.
