any complaint 73 291 referred to the Financial Ombudsman Service, except where:

  1. (a) the Ombudsman considers it apparent from the73291 complaint 73 291 , when it is received, and from any final response or redress determination119294 which has been issued by the firm or licensee289, that the73291 complaint 73 291 should not proceed because:
    1. (i) the complainant is not an eligible complainant in accordance with DISP 2; or
    2. (ii) the73291 complaint 73 291 does not fall within the jurisdiction of the Financial Ombudsman Service (as described in DISP 2); or
    3. (iii) the Ombudsman considers that the73291 complaint 73 291 should be dismissed without consideration of its merits under 176296DISP 3.3.4 R or DISP 3.3.4A R (2)to (5) 176296(Dismissal of complaints without consideration of the merits73291176296); or
  2. (b) the Ombudsman considers, at any stage, that the73291 complaint 73 291 should be dismissed under73291 DISP 3.3.4 R (2) 73 291 or DISP 3.3.4A R (1)176296 on the grounds that it is frivolous or 3113176296vexatious; or176296

(c) the Ombudsman considers it apparent from the complaint when it is received, and from any redress determination which has been issued by the respondent, that the respondent has reviewed the subject matter of the complaint and issued a redress determination in accordance with the terms of a consumer redress scheme, unless the complainant and the respondent agree that the complaint should not be dealt with by the Ombudsman in accordance with the consumer redress scheme.176296298
