    (1) (except in REC) 20(as defined in paragraph 10 of Schedule 3 to the Act (EEA Passport Rights)) either a person:75

      1. (a) whose head office is in the United Kingdom and who has an EEA right to carry on activity in an EEA State other than the United Kingdom; or75
      1. (b) whose registered office is in the United Kingdom and who has an EEA right which derives from the IDD to carry on an activity in an EEA State other than the United Kingdom.75

    (2)

    (in REC) means an investment firm or credit institution which has a Part 4A permission 99 to carry on one or more regulated activities.20
