subsisting rights

135has the meaning given in section 76 of the Pension Schemes Act 2015 which is:

  1. (a) for a member of a pension scheme:
    1. (i) any right which has accrued to or in respect of the member to future benefits under the scheme; or
    2. (ii) any entitlement to benefits under the scheme;
  2. (b) for a survivor of a member of a pension scheme, any right to future benefits, or entitlement to benefits, which the survivor has under the scheme in respect of the member.
