establishment conditions

(in relation to the establishment of a branch in the United Kingdom) the conditions specified in paragraph 13 of Schedule 3 to the Act (EEA Passport Rights), which are that:

  1. (a) if the firm falls within paragraph (a), (b), (c), (d) or (f) in the definition of "EEA firm"16.126126
  2. (b) if the firm falls within paragraph (e) in the definition of "EEA firm":16
    1. (i) the appropriate UK regulator has received notice (“a consent notice”) from the firm’s Home State regulator that it has given the firm consent to establish a branch in the United Kingdom;126
    2. (ii) the consent notice is:126
      1. (A) given in accordance with the IDD;126
      2. (B) identifies the activities to which the consent relates; and126
      3. (C) includes such other information as may be prescribed; and 126
    3. (iii) the EEA firm has been informed of the applicable provisions or one month has elapsed, beginning with the date on which the appropriate UK regulator received the consent notice.126

  3. (c) the EEA firm has been informed of the applicable provisions or two months have elapsed beginning with the date when the173 FCA or PRA (as the case may be)173 received the consent notice.4
