    any complaint 73 289 referred to the Financial Ombudsman Service, except where:

      1. (a) the Ombudsman considers it apparent from the73289 complaint 73 289 , when it is received, and from any final response, summary resolution communication 297 or redress determination119292 which has been issued by the firm or licensee287, that the73289 complaint 73 289 should not proceed because:
        1. (i) the complainant is not an eligible complainant in accordance with DISP 2; or
        1. (ii) the73289 complaint 73 289 does not fall within the jurisdiction of the Financial Ombudsman Service (as described in DISP 2); or
        1. (iii) the Ombudsman considers that the73289 complaint 73 289 should be dismissed without consideration of its merits under 176294DISP 3.3.4 R or DISP 3.3.4A R (2)to (5) 176294(Dismissal of complaints without consideration of the merits73289176294); or
      1. (b) the Ombudsman considers, at any stage, that the73289 complaint 73 289 should be dismissed under73289 DISP 3.3.4 R (2) 73 289 or DISP 3.3.4A R (1)176294 on the grounds that it is frivolous or 3113176294vexatious; or176294
      1. (c) the Ombudsman considers it apparent from the complaint when it is received, and from any redress determination which has been issued by the respondent, that the respondent has reviewed the subject matter of the complaint and issued a redress determination in accordance with the terms of a consumer redress scheme, unless the complainant and the respondent agree that the complaint should not be dealt with by the Ombudsman in accordance with the consumer redress scheme.176294296
